1. Applicability

1.1 These General Terms and Conditions apply to all offers, orders, products, deliveries, and agreements concluded between Van Schaaijk Studio, hereinafter referred to as "the online store", and its customers, unless expressly agreed otherwise in writing. 1.2 By using the online store and placing an order, the customer accepts these General Terms and Conditions.

2. Offer and Order

2.1 The offer of the online store is non-binding and can be changed at any time.

2.2 Orders can be placed via the online store.

2.3 The agreement is concluded at the moment the online store confirms the customer's order.

3. Prices and Payment

3.1 All prices on the website of the online store are stated in euros and include VAT.

3.2 The customer must make payment in advance via the payment methods offered on the website of the online store.

3.3 In the event of non-payment, the online store reserves the right to cancel the order.

4. Delivery

4.1 The delivery time of the order depends on the availability of the products.

4.2 The online store will make every effort to deliver the order as soon as possible.

4.3 Delivery takes place at the address provided by the customer.

4.4 The online store is not liable for delays in delivery caused by third parties.

5. Customs & Import Duties

5.1 Orders shipped outside the EU may be subject to import duties, taxes, and/or customs charges upon arrival.

5.2 These costs are not included in the product price or shipping fee.

5.3 The customer is responsible for paying any applicable import duties and customs charges.

5.4 Van Schaaijk Studio is not liable for any delays caused by customs clearance processes.

6. Right of Withdrawal

6.1 The customer has the right to terminate the agreement within 14 days of receiving the order without giving any reasons.

6.2 Specially designed or personalised jewellery items are final purchases and cannot be returned.

6.3 To exercise the right of withdrawal, the customer must send a written declaration of termination to the online store within the specified period.

6.4 The customer must return the products to the online store within 14 days of terminating the agreement, undamaged and in the original packaging.

7. Warranty 

7.1 The online store guarantees that the delivered products comply with the quality standards and are free from manufacturing defects.

7.2 Within the warranty period of 6 months from delivery, the customer has the right to repair, replace, or refund the product if defects are found in the delivered products.

7.3 The customer must report any defects to the online store as soon as possible after discovery.

8. Liability 

8.1 The online store is not liable for any direct or indirect damage suffered by the customer as a result of the use of the delivered products, unless there is intent or gross negligence on the part of the online store.

8.2 The total liability of the online store, for whatever reason, is limited to the amount covered by the insurance of the online store in the relevant case.

8.3 If the insurance does not provide coverage or the damage is not covered by the insurance, the liability of the online store is limited to the invoice amount of the relevant order.

9. Intellectual Property Rights 

9.1 All intellectual property rights relating to the website, its content, and the delivered products remain with the online store or the respective rights holder.

9.2 The customer is not allowed to use, reproduce, or distribute the intellectual property rights without the prior written consent of the online store.

10. Privacy 

10.1 The online store treats the customer's personal data confidentially and in accordance with applicable privacy laws.

10.2 Personal data is only used for processing orders and providing information to the customer.

10.3 The online store will not disclose the customer's personal data to third parties unless necessary for the performance of the agreement or based on legal obligations.

11. Complaints and Disputes 

11.1 Complaints about the delivered products or the services provided must be reported to the online store in writing as soon as possible, but no later than 14 days after discovery.

11.2 The online store will respond to the complaint within a reasonable period and strive for an appropriate solution.

11.3 Dutch law exclusively applies to agreements between the online store and the customer. 10.4 Disputes between the online store and the customer will be submitted to the competent court in the place of business of the online store in the first instance.

12. Amendment of the General Terms and Conditions 

12.1 The online store reserves the right to amend or supplement these General Terms and Conditions.

12.2 Any changes will take effect from the moment of publication on the website of the online store.

13. Final Provision 

13.1 If a provision of these General Terms and Conditions is declared invalid or unenforceable, this does not affect the validity of the other provisions.

13.2 In case of discrepancies between different language versions of these General Terms and Conditions, the Dutch version prevails.
